Welcome to the Provider Centre

1. ACCEPTANCE OF TERMS

The Website is operated by Provider Centre (ABN 49 610 695 068). The PROVIDER CENTRE is specially designed for all those who participate within the National Disability Insurance Scheme (NDIS) and also those who provide services under the scheme including registered and non-registered providers.

If you choose to access or use the PROVIDER CENTRE you are agreeing to abide by the terms and conditions of use detailed below (along with any other terms, conditions, and policies mentioned within the T & C below and any other notifications that form part of the PROVIDER CENTRE as occasionally amended. If you refuse to accept these terms, you must stop using the website or any services provided by it immediately.

PROVIDER CENTRE offers no warranty or endorsement of how reliable, accurate, or complete any Material published on the PROVIDER CENTRE or other websites linked to from the PROVIDER CENTRE may be, nor has it authorized them or does it represent them. This includes advertising derived from third parties.

PROVIDER CENTRE offers no warranty for any services or goods offered for purchase on the PROVIDER CENTRE by any third parties. This includes, but not exclusively, all representations or warranties from those providing goods or services that they are safe for their intended use, fit for their intended purpose, or of acceptable quality for sale.

 

2.Using NDIS PROVIDER CENTRE

To employ the services offered here, you must be aged 18 years and above. Usage will constitute agreement that you will only make postings related to services or goods available in Australia, that you will only post things appropriate to the area or category in which you place them, and that your postings will not represent any of the transgressions below:

  • Do anything in violation of Australian law: prior to publishing an advertisement on PROVIDER CENTRE, the advertiser is responsible for ensuring that the content violates no posting policy of PROVIDER CENTRE, nor does it violate any applicable Australian law;
  • Represent any threat or abuse, defame any person or organization, or represent any indecent or obscene materials;
  • Make any statements or claims that are untrue or misleading;
  • Violate the rights of any third parties;
  • Assist in distributing or sending any communications in the form of spam, pyramid schemes, or chain letters;
  • Share viruses or other forms of malicious content that could damage PROVIDER CENTRE, its provided services, or the property or other interests of users of PROVIDER CENTRE;
  • Place unnecessary or unreasonable strain on the infrastructure of PROVIDER CENTREor interfere in any way with the smooth running of our services;
  • Be responsible for copying, modifying, or distributing content posted by another person without their agreement;
  • Employ any robotic spider, scraper, or other technological mechanisms for accessing our services or harvesting content for any reason without prior permission in writing;
  • Harvesting or in any other way collecting information regarding other users, which includes their email addresses, unless you have their consent;
  • Circumvent any mechanisms employed for the blocking or restriction of access to our services;
  • Make any postings or advertisements with the aim of accruing profit from any form of tragic event, natural disaster, or concerns about public health or safety.

 

3.Solely for Personal and Non-Commercial Usage

The PROVIDER CENTRE may only be used for personal, non-commercial purposes. Apart from the Material stored in the cache on your computer, or one hard copy of the Material solely for your own use, you may not, unless given written approval from PROVIDER CENTRE beforehand:

  • Be responsible for modifying, copying, distributing, transmitting, displaying, performing, reproducing, publishing, or licensing any Material;
  • Employ, or attempt to employ, any published Material from the PROVIDER CENTRE for the creation of any searchable databases, publications, websites;
  • Undertake framing of any pages or websites on the PROVIDER CENTRE;
  • Employ any form of automated processing for querying, accessing, retrieving, scraping, data mining, or copying any of the Material within the PROVIDER CENTRE or for the generation or compilation of any databases, indexes, or documents employing, directly or indirectly, any Material held on the PROVIDER CENTRE;
  • Be responsible for transferring or selling any information, products, services, or functionality on offer from the PROVIDER CENTRE;
  • Perform any additional actions that violate any of the terms and conditions detailed here, that violate any additional policies or terms and conditions mentioned within these terms and conditions, or any relevant laws.

Should PROVIDER CENTRE regard you or any person or entity that has a relationship with you (this includes associates, contractors, representatives, and agents) have taken action that violates these terms and conditions or that is in any way detrimental to the interests of PROVIDER CENTRE, your rights of access may be instantly terminated, and the PROVIDER CENTRE retains the right to pursue any further action deemed appropriate for the prevention of these actions being repeated and/or to prevent you accessing the PROVIDER CENTRE in future. All decisions on these matters shall be taken solely by the PROVIDER CENTRE and all decisions are final.

 

4. Abuse of NDIS PROVIDER CENTRE Services

PROVIDER CENTRE endeavors at all times to keep its services in proper working order and to protect its community. If you see any breaches of policy, offensive content, or other problem, advise us immediately. You have sole responsibility for any information you provide to PROVIDER CENTRE and all consequences arising from your postings. We may, at our sole discretion, reject, delete, or remove any content that we believe not to be appropriate or to be in breach of the terms and conditions. We may also, at our sole discretion, impose either temporary or permanent restrictions on a user accessing our services, or we may refuse to allow a user to register. Whilst still reserving all our legal rights, we have the right to impose warnings, limitations or termination of our services, to erase any content posted on the site, and to employ any or all legal or technical measures to deny users access to our services if we believe they are causing difficulties or not acting in accordance with either the spirit or letter of our published policy. Nevertheless, whether or we not take such actions, PROVIDER CENTRE accepts no liability for the unauthorized or unlawful use of our services, for any unauthorized or unlawful content placed on our services, and we are not liable to monitor the services. By using PROVIDER CENTRE you agree that we have no obligation for monitoring data/content provided to or made available through our services.

 

5.Your responsibility for using the NDIS PROVIDER CENTRE Network

Although all reasonable steps are taken in ensuring that any material provided by the PROVIDER CENTRE is accurate, up-to-date, and error-free, PROVIDER CENTRE offers no warranty regarding how accurate or complete any material on the network, any websites linked to from the network, or any information provided by others due to your use of the PROVIDER CENTRE. You have sole responsibility for determining how accurate any material on the network may be, and any reliance you place on it is entirely your responsibility.

Any material or services provided by the PROVIDER CENTRE be regarded as being solely for the purpose of general information. Any materials or services provided do not represent expert/professional or any other type of advice and do not represent an acceptable replacement for it. Any services or material may not necessarily be adequate, accurate, or appropriate for your particular case and you should not rely on it as a sole motivator for taking or not taking any action. No material is guaranteed to be continuously accessible nor is it guaranteed to be virus- or error-free.

In using this website you guarantee that you provide indemnification for PROVIDER CENTRE in the event of all demands, claims, losses, or liabilities should PROVIDER CENTRE (and any agent, employee, representative, or officer associated with it) incur any losses, damages, or costs caused by any breach of these terms and conditions by yourself (or any agent, employee, representative, or officer associated with you).

Your username and password for accessing the PROVIDER CENTRE must be kept safe and secure; you must not disclose your username or password to any third parties in any circumstances. You hereby assume liability for any losses or other damage caused by all unauthorized employment of your username and password.

 

6. Third-Party Goods/Services

In relation to all services and/or goods advertised either on or via the PROVIDER CENTRE by third parties (Providers):

  • You have responsibility for undertaking any and all appropriate investigations, enquiries, and/or searches regarding any provider listed on the service;
  • PROVIDER CENTREis in no way a broker or agent for any individual, it does not take responsibility for arranging any contracts between yourself and any third party, nor does it offer any warranty regarding the goods or services supplied by any third party;
  • PROVIDER CENTREhas no responsibility for any terms and conditions related to any transactions enacted by you with any third party, has no responsibility for the quality or otherwise of any services or goods supplied to you by any third party, nor does it have responsibility to mediate any disagreement between yourself and any third party.

 

7. Limitation of liability

  • PROVIDER CENTRE is not liable to you or any third party in any way (whether under statute, contract, tort, negligence or otherwise) arising under or in connection with the sale, delivery, use of, storage or any other dealings with the website or services or products listed on the website.
  • PROVIDER CENTRE is not liable to you for any consequential loss or expense suffered by you or any third party however caused, including but not limited to loss of profits, business, revenue, savings, opportunity, reputation, access to markets, publicity or goodwill or any such liability to, except to the extent of any liability imposed by the Australian Consumer Law.
  • You acknowledge and agree that:
    • you have not relied on any service involving skill and judgment, or on any advice, recommendation, information, reports, tests or assistance provided by PROVIDER CENTRE in relation to website or any services provided on it or their use or application.
    • you have not made known, either expressly or by implication, to PROVIDER CENTRE any purpose for which you require the website or the services;
  • Nothing in these T&Cs is to be interpreted as excluding, restricting or modifying or having the effect of excluding, restricting or modifying the application of any State or Federal legislation applicable to the sale of goods or supply of services which cannot be excluded, restricted or modified. You accept that our service is limited to connecting users and providers. We do not have any control over any purchases or payments that are made concerning the products or services that are offered for sale on the Site. To the maximum degree allowable by statute, we do not have any responsibility for dealing with, and are not legally responsible for, any disagreements or grievances made by you or any user in relation to the Products or Services sold on, or via, the site.

 

8.Release and indemnity

You indemnify PROVIDER CENTRE and each member of PROVIDER CENTRE’s personnel from and against Liability or Claim, directly or indirectly in relation to:

  • the accuracy of all information provided on the website
  • any statements made on the website (including any defamatory statements);;
  • your breach of these T&Cs;
  • the negligence or wilful misconduct of you or any member of your personnel;
  • the provision of the services by you to any third party, or the sale of any products to any third party;
  • your services or any products sold not being fit for any particular purpose;
  • any liability caused by any interference, decision, or disruption caused by any third-party (including, but not limited to property owners, tenants, union officials and their agents or any other trades).
  • any proceedings, claims and demands in relation to the services provided or products sold.

 

 9.Security

  • 9.1. In consideration of PROVIDER CENTRE providing the site services, you hereby charge in favour of PROVIDER CENTRE all of your right, title and interest (whether joint or several) in any land, realty or other assets capable of being charged, which are owned by you either now or in the future, to secure the performance by you of your obligations under these T&Cs including, but not limited to, the payment of monies owed to PROVIDER CENTRE.
  • 9.2. You hereby consent to the registration by PROVIDER CENTRE of a caveat against the title of any property owned by you to support the charge created by clause 9.1.

 

10.Access to Our Site

We grant access to our site as temporary permission, reserving all rights of withdrawal or amendments of the services provided by our site with no prior notice (see below). We have no liability for any consequences arising should this site not be available at any particular point in time or for any particular time.

 

11.Intellectual Property Rights

PROVIDER CENTRE is the owner/licensee of all intellectual property rights associated with the site and for all material it publishes. All material enjoys the protection of global & Australian copyright laws/treaties. PROVIDER CENTRE reserves its rights to all works. Extracts from any pages on this site may be downloaded or printed off for individual use and you may alert colleagues from your own organization to material available on the site.

You must always acknowledge our authorship of any material from our site and the authorship of any acknowledged contributors. No materials from our site may be used wholly or in part for any commercial purpose unless you have obtained a license for this from ourselves or our licensors. Should you download, copy, or make printouts of any section of our website in a way that breaches these terms and conditions, you will immediately forfeit your rights to use our site and either destroy or return all copies taken off our material (our option).

Please note that any records and content provided in hard copy format may be stored and scanned electronically by PROVIDER CENTRE.

PROVIDER CENTRE, and the PROVIDER CENTRE Network, do not collect sensitive information as defined in the Privacy Act, such as racial or ethnicity information, political opinions or associations, criminal records (save where provided by law enforcement authorities) or health information. However, subject to obtaining your prior consent, PROVIDER CENTRE may collect sensitive information from you in the course of considering an application for employment.

    • professional advisers;
